Unpaid Work, Scams, and the Perils of Freelance

Hey all,

While I am sure this post will come across as passive aggressive in a way, I have been at my wits end attempting to get payment from a client I was working with. I did a full week (read: 45 hours+) work for this individual and have been getting the runaround about payment ever since. I have very little recourse, since this individual (I believe) provided me with false information when I was initially contacted. Thus, I have little way of contacting them. This post, hopefully, will prevent anyone else from falling victim to this type of ordeal.

That is the full conversation. Take from that what you will. But I further went into Skype and added a person named Jacio Loterm, who was the person with the same name as the gmail account I was provided (Skype ID: jacio.loterm). This person would not share contact information with me like Kate Rieger did (Skype ID: kate.rieger4). Neither of these individuals have the name that the PayPal account (jacioloterm@gmail.com) was linked with; Horace Mond. And none of them have the name of the initial Elance ID I was speaking with.

Was this foolish on my part? Yes. It was simply too good to be true. But at least now they won’t be able to pull this scam on anyone else. If anyone reading this has seen their work appear on any of these links, PLEASE contact me and I will be glad to work with you.

UPDATE 10/3/14

So I had an email from another freelancer who was scammed by the same people (using the jacioloterm@gmail.com PayPal address). I have more information to share:

The Elance ID I was contacted by was jamesanderson100. This ID has since been deleted, to my knowledge. The image below shows my contact with this individual where you can see mention of the kate.rieger4 Skype ID.

Job Posting

I have also attached the PDF image of the job posting for the other individual that I spoke with. Now, they contacted this individual using different information. The scammer in his case was named “Pete Adams” and used the Skype ID peter.adams997. The Elance name (which was since deleted) of the individual who contacted him is Mouraine B. Take this information how you will. Both of the Elance profiles were apparently from Kenya. I don’t want to make a broad generalization here, but this is not the first time I have encountered scammers from Kenya and I would make a habit of requesting ALL payment up front prior to beginning any work.

I think you used a quite inadequate tone in your comment, but I will consider that as a bi-product of the frustration that built up because of what happened to you. I also think that you jumped a bit too hastily to conclusions. I couldn’t have known that you, Alex Maness, wrote that article. I have never heard about you. This might come as a surprise, but you’re not such a globally known writer, nor is your writing style so unique that anyone reading one of your articles will instantly know that it’s written by you

Back to what happened to you. I think it’s completely unfair. As I mentioned before, I contracted that specific piece of content on iwriter.com, from a user that goes under the username “chrisadams”. I recommend you contact iwriter.com and try to discuss more details about your case. Maybe they can help you further.

I’m a freelance writer using elance exclusively and have for many years. I hate that this happened to you and – knock-on-wood- I’ve been fortunate to find great paying clients. However, if you don’t mind me hijacking your comments section for a minute, I’d like to share some tips for newbie writers in order to better protect themselves.

1. Never, Ever, Ever communicate outside the freelance site you’re using.
2. Never, Ever, Ever agree to payment or tracking outside of the freelance site you’re using. The site has protections built in place just for this reason. Sometimes they are a pain in the a**, but better safe than sorry.
3. If you are writing for a fixed fee, never, ever provide a draft without the escrow being funded. If they won’t fund it, you don’t write it. Not much you can do about an hourly rated job, but elance is pretty good about validating the client’s bank account before letting it get that far. Although I’ve had no problems with hourly jobs, I very rarely take them for just this reason.
4. Never apply for a project unless specific details for ONE project are given – i.e. the content of the article, the word count, the specific project goal (article, blog post, eBook, etc). It’s been my experience that jobs that are “I need a writer for lots of stuff”, “Writers needed NOW for daily work!” are either scams, want cheap content spinners, or won’t award the job because they don’t really know what they want. They may look enticing, but they are a waste of your time and in some cases, they can hurt you.

Hey Linda,

Thanks for your post. I already knew all of that, but I didn’t trust my gut. Your post might help the other six people who have messaged me about this same individual, all of whom are owed upwards of $500.

My solution, of course, was simple. I reported them to the authorities, had their accounts banned on iWriter (a haven for these scammers, apparently), had all of the articles taken down from the websites they ended up on via DMCA takedown notices (and subsequently got paid for a few of them), had the individual banned on Elance, and publicly posted all of their information.

Subsequently I have had a contract drawn up and work with an escrow service outside of Elance. Anyone based outside of the US who I have not worked with in the past has to pay a minimum of 50% up front, often 100%. In my experience, though I did get some good paying work from it, Elance and other freelance sites are small-potatoes and generally not worth the trouble a person puts into using them. 99% of the jobs listed are either fake or will pay you so far below market rate it’s ridiculous. It is much easier to simply direct pitch clients and market your services in the real world.

I would like to apologize for redacting a part of your final paragraph, here is the reasoning: While I clearly made a mistake here and owned up to it, I felt like you were painting me in a bad light. I am sure it wasn’t your intention, but I made a decision. If this offends you, I will put it back the way it was.

Can’t believe I didn’t do a Google search to see your post BEFORE I started work for ‘Stacy Rae’. Thank goodness I only did 2 hours before my suspicions properly kicked in. I am so sorry you got taken for more. Got the job on Freelancer. No milestone payment (so I can’t dispute anything – that will teach me)… My scammer was stacyrae654@gmail.com / stacyrae654 on Freelancer / stacy.rae4 on Skype. I asked for a quick video chat to say hi and she said she couldn’t do video on her equipment and her mic not working, so I asked for FB or LinkedIn or company info etc and it was all bull… Same scenario, exact same post layout… I asked for a pic and ‘she’ sent me one that was obviously Googled… Uh, these people make me sick. I have bad health and my hands are so painful after just 2 hours work and ‘she’ expected me to work 50 hours this week before a cent. I’m hoping ‘she’ left some trace evidence behind with an IP address or something… It’s disgusting. I can’t afford to work for free and these sickos are taking advantage of us.

Hi Alex,

I am banging my head on the table in frustration that I didn’t read this blog post a week ago. I have been taken for the exact same scam and I’m absolutely devastated.

I thought it was a bit strange at first that they insisted on hourly work, but I thought that as long as I used Elance time tracker to prove the work done I would be fine… that Elance would guarantee the payment. After all, that’s what time tracker is for, right?

I foolishly did over a week of work for this horrible thieving bastard and now they have disappeared, blocked me on Skype, etc. The automatic payment on Elance for the Elance time tracker is not going through. I am owed around $1500.

I have taken it up with Elance support, but so far when I spoke to them on the phone they have said that they can only chase the client for the payment but they can’t guarantee payment for me. If the client doesn’t pay I am on my own and they will give me the client’s contact detais so I can pursue it in court. That seems pretty useless – what’s the point of Workview? Why call it a guarantee if Elance won’t be responsible for protecting freelancers from scammers? Also, there’s no chance that this slippery scammer used real contact details or even a real payment method when signing up for Elance. What is Elance’s way of ensuring that the clients who sign up and commit to paying for 40-50 hours of work are real people who will actually pay those freelancers?

Do you have any suggestions of what I can do? I Copyscaped some of my articles and saw that they have already been published on other blogs. Have you had any success contacting the owners of these blogs?

Hey Kelly,

Unfortunately, NO. Elance won’t help you. In fact, they will be less than helpful. If they cared, they would screen people listing jobs prior to hiring and require funding before any work can actually begin, rather than allowing work to begin prior to any funding.

With regard to getting anything done, here is what I did. The only thing I hoped was that it would tank the reputation of whatever site the scammer got their jobs from (iWriter.com in my case and in the case of some others). Run Google searches for paragraphs of your articles, then notate any sites that you find them on. I did this once a week for a couple months. Every time I found one, I would run a whois on the site to find out the ISP they owned and take down the URL of the article I found. I would write an email to the site owner alerting them and, if I didn’t hear anything back within a week, I would then send a DMCA takedown notice (http://www.ipwatchdog.com/2009/07/06/sample-dmca-take-down-letter/id=4501/) and send it to the ISP. Legally, they have to remove it. They did, and in a couple of cases the owners of the sites contacted me to pay for my work. Others have told me this was overkill. Frankly: No. It is not overkill. Someone stole your work and sold it and, just like it the police found a pawn shop with stolen goods, the person in possession does not own those just because they have them.

I also reported them on this site: http://www.fbi.gov/scams-safety/fraud/internet_fraud and I had no problem telling them in my statement that Elance was partially responsible for this kind of thing happening due to their policies. Overkill? Idk. Maybe. But I also don’t care, because we have all been defrauded in this same way by the same people on the same platform and the issue could EASILY be fixed by Elance, they just don’t fix it.

Alex, my friend, I am so glad i had the chance to talk to you today about what happened to me. Everything was exactly the same, right down to the screen names. In retrospect, I can see things very clearly. They were there all along. It really was too good to be true. I got bilked out of about $350. All I can do is sit here shaking my head at my own stupidity. Thanks for the post. I sure wish someone else sees it first. Steve
